These terms will be governed by and construed in accordance with the laws of the United Kingdom without regard to its conflicts of law provisions. Any legal action arising from your use of this website shall take place in a court located in the United Kingdom. These Terms of Use shall be construed in accordance with the laws of England.

Entire agreement

These terms and conditions, together with the Privacy Policy, constitute the entire agreement between you and Liberty Retirement Living in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Liberty Retirement Living Prize Draw Terms & Conditions

1. No purchase necessary to enter the prize draw.

2. This prize draw is open to UK residents aged 18 years or over, with the exception of employees of the Promoter, their families, agents and anyone else connected with this promotion.

3. Entries must be received by midnight on 3rd September 2017. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter by the relevant closing date for any reason. Proof of posting or sending is not proof of receipt. Automatically generated entries and entries via agents or third parties are invalid and shall not be considered. Entries become the property of the Promoter and are not returned.

4. The Promoter or its agencies will not be responsible for the non-inclusion of entries or any claims as a result of being lost, late, illegible, incomplete, invalid, or because of technical failures or otherwise, including such failure which is within the control of the Promoter or its agencies.

5. Only one entry per person No entrant may win more than one prize.

6. To enter please complete the invitation reply form and return your invitation in the supplied envelope to Liberty Retirement Living, The White House, 10 Clifton, York, Yorkshire YO30 6AE, or contact liberty Retirement Living via the contact form on the website – libertyretirement.co.uk/chapelton/contact/ - to request an entry form.

7. All correctly completed entries will be entered a prize draw which will take place on 4th September 2017. The first entry drawn will be the winner.

8. The prize for the winner is £250 in value of John Lewis vouchers and will be subject to a 24 month expiry period. The winner will forfeit the £250 in John Lewis vouchers if they fail to redeem these within the 24 month period from the date of the vouchers.

9. The Prize is subject to availability. In the event of unforeseen circumstances, the Promoter reserves the right (a) to substitute an alternative prize of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into.

10. The winner will be notified via email or post by 8th September 2017. The winner must claim their prize within 30 working days of the Promoter sending notification. If the prize is unclaimed, rejected or non compliance with these terms and conditions, then after 20 October 2017, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules on a subsequent date. If a winner does not respond by 20 October 2017 or if any prize notification is returned as undeliverable, if the winner does not accept the prize or in the event of non-compliance with these prize draw terms and conditions, the Promoter reserves the right to withdraw prize entitlement and the prize will be forfeited and an alternative winner may be selected. Upon prize forfeiture, no compensation will be given.

11. The prize is as stated and is non-transferable and non refundable. No cash or other alternative is available (in whole or in part), except that in the event of circumstances outside its control, the Promoter reserves the right to provide a similar prize of equal or greater value.

12. To obtain details of the winner please email enquiries@libertyretirement.co.uk stating the name of the prize draw in the subject heading within 4 weeks after the closing date.

13. By entering this prize draw, all entrants consent to the use of their personal data by the Promoter for the purposes of the administration of this prize draw and any other purposes to which the entrant has explicitly consented.

14. The Promoter may disqualify any entrant whose entry does not comply with these terms and conditions (in Promoter’s sole opinion) or who, in Promoter’s sole determination, has acted in a manner that is fraudulent, dishonest or unjust to other entrants including, without limitation, tampering with the operation of the prize draw, manipulating or rigging votes, hacking, deceiving, cheating or by harassing or threatening other entrants or a representative of Promoter.

15. The Promoter reserves the right to require the winner to provide proof of identity, age and residency, as the Promoter may deem necessary.  Identification considered suitable for verification is at the Promoter's discretion.

16. By entering the prize draw the entrant agrees to be bound by these terms and conditions and by the decisions of the Promoter, which are final in all matters relating to the prize draw.

18. Nothing in these terms and conditions seeks to restrict your statutory rights as a consumer, or seeks to exclude or limit the Promoter's or the prize provider's liability for death or personal injury caused by their negligence or for fraud or any other liability that cannot be excluded by law.

19. The Promoter will only send marketing literature by email to entrants who have "opted-in" on the relevant entry form to receive emails in respect of further information from the Promoter and its affiliates and/or the prize provider and its affiliates.  The Promoter may send marketing literature to entrants by post, but will always provide recipients with an option to "opt-out" of such marketing communications at any time.
